1. Who we are and what these Terms cover
This website is operated by Atlantis Strength Inc. (Atlantis Force Inc. in French), a corporation governed by the Canada Business Corporations Act (corporation number 207503-2), whose registered office is at 4745 avenue des Industries, Laval, Quebec H7C 1A1, Canada. You can write to us at info@atlantisstrength.com.
In these Terms, “Atlantis”, “we” and “us” mean this corporation; “you” means any person who uses the site; “the site” means the website on which these Terms are published.
These Terms govern the use of the site from their effective date, shown at the top of this version and in the version history at the bottom of this page. Section 11 explains how they replace the previous version, how they may be changed and what you can do if you do not accept them.
2. Your personal information
How we handle your personal information is explained in our Privacy Policy. The Privacy Policy is a separate information notice: it is not part of these Terms and is not incorporated into them. It is updated under its own rules, and the rights it describes do not depend on your acceptance of these Terms.
3. The site sells nothing online
The site is used to present our products and to receive your requests. Nothing can be bought or paid for on it.
- “My project” and “Quick order” are tools that help you draw up a list of machines. That list is not an order: it creates no obligation, for you or for us.
- A request for a quote, made through a form on the site or otherwise, is neither an offer nor a contract. A sale can result only from a written quote that we give you and that you accept, on the terms it states, or from a contract made with us.
- Information about our products (descriptions, specifications, dimensions, images, colours, finishes) is meant to help you make your choice. The configurator’s renderings illustrate the configuration you choose. Colours and finishes seen on screen may differ from the actual product. The written quote or the contract describes what we sell you. If you are a consumer, what we or our representatives state about a product, on this site or elsewhere, also binds us, as the Quebec Consumer Protection Act provides (ss. 41 and 42).
- The warranty on our products is the one set out in the written warranty document that applies to them, presented on the Warranty page. If you are a consumer, a warranty mentioned elsewhere on the site or in our advertising also binds us (Consumer Protection Act, s. 43). If you notice a difference, write to us. None of this reduces the warranties the law gives you.
- The manuals and guides offered on the Manuals & Guides page must be followed to install, use and maintain our equipment safely. Use the most recent version, and contact us if in doubt.
4. What you send us
When you send us information, messages or files through the site (forms, requests, applications, problem reports):
- they must be accurate, and you must have the right to send them to us, in particular when they concern another person or another person’s work;
- they must not contain any malware or any file designed to cause harm;
- you allow us to use them to follow up on your request.
Job applications
Sending an application or a résumé through our Careers pages is not a promise of employment and creates no employment relationship. Only a written offer of employment from us can create that relationship.
Distributor applications
An application to become a distributor gives no distribution right, no exclusivity and no territory. A distribution relationship can arise only from a written agreement signed by Atlantis and by you.
Problem reports and screenshots
When you report a problem on the site, your report may include a screenshot of the page. Do not put any confidential information in it, and check what the screenshot shows before you send it.
Suggestions
If you share an idea or a suggestion about our products or the site, we may use it freely, with no obligation to pay you. This does not cover your personal information, which continues to be handled under the Privacy Policy.
5. Acceptable use
You may use the site to learn about our products and to contact us. You agree not to:
- use a robot, a data scraper or any other automated means to browse the site, extract its content in bulk or fill in its forms, unless it is a public search engine that follows the rules in our robots.txt file;
- probe, scan or test the vulnerability of the site or of our systems without our written permission;
- overload the site or interfere with its operation, for example by sending requests or forms in bulk;
- get around a security measure, a limit or an access control, or try to reach a part of the site reserved for our staff;
- use the site for an unlawful, fraudulent or misleading purpose, including by impersonating another person.
We may block any access that does not follow these rules.
6. Intellectual property
The content of the site (text, photos, videos, illustrations, documents, logos, design and layout) belongs to us or is used with the permission of its owners. It is protected in particular by copyright and trademark law. The names and logos shown on the site belong to Atlantis or to their respective owners; their presence on the site gives you no right to use them.
You may view the site and download, print or keep the documents we offer on it, such as manuals, guides and colour charts, for your personal use or for the internal needs of your organization, in particular to choose, install, use and maintain our equipment. You must then keep them intact, without removing any copyright notices they carry. Any other reproduction, distribution, modification or commercial use requires our prior written permission, except where the law allows it without permission.
7. Third-party links and services
The site contains links to third-party websites and includes some services provided by third parties, such as those in the table below; our Privacy Policy lists all of them, with what each may receive. Those websites and services have their own terms of use and privacy policies, which we invite you to read. We control neither their content nor how they work, and a link to a third-party website does not mean that we endorse it.
| Site feature | Third-party service | When it is contacted |
|---|---|---|
| OpenStreetMap map on the contact pages | OpenStreetMap map (tile.openstreetmap.org) | Automatically, without a click, when the map on the contact pages comes close to the screen |
| YouTube videos on product pages | YouTube video player (youtube-nocookie.com) | Only when you click a video; before that, the page shows only an image and nothing is loaded from YouTube |
| Booking a meeting (HubSpot calendar) | HubSpot booking calendar (meetings.hubspot.com, or its regional address), preceded by a HubSpot script (hsappstatic.net) when the calendar is displayed directly in the page | Depending on our settings: when you click to book, or as soon as the page opens when the calendar is displayed directly in it; HubSpot’s privacy policy also applies inside the calendar |
| HubSpot tracking code and consent banner | HubSpot tracking code (hs-scripts.com), which then contacts other HubSpot servers | Only after you accept in the consent banner; before that, nothing is loaded or sent |
| HubSpot forms embedded in the pages | HubSpot forms (hsforms.net and hsforms.com), displayed in the contact, configurator, distributor, product registration and new arrivals pages | As soon as these pages open, when our settings display the forms in them; HubSpot’s privacy policy also applies inside the form |
What these services may receive about you is explained in the Privacy Policy.
8. Accuracy of information and liability
We take care to keep the content of the site accurate and up to date. It may nevertheless contain errors, omissions or outdated information, and the site may be interrupted, for example for maintenance. We therefore do not guarantee that the site is free of errors or available without interruption. If you notice an error, write to us: we will correct it where appropriate.
Nothing in these Terms:
- excludes or limits our liability for bodily or moral injury caused to another person, or for intentional or gross fault;
- releases us from the consequences of our own acts or of those of our representatives where the Quebec Consumer Protection Act applies to you;
- deprives you of the rights and warranties that the law gives you and that cannot be waived by contract, in particular in consumer protection matters.
9. Governing law and courts
These Terms are governed by the laws in force in Quebec, including the federal laws of Canada that apply there. If you are a consumer, this choice does not deprive you of the protection given to you by the rules of the law of the place where you reside that cannot be set aside by contract.
The courts of Quebec have jurisdiction to hear any dispute about the site or these Terms. If you are a consumer, this clause does not prevent you from going to the courts of the place where you are domiciled or resident, where the law allows you to do so.
These Terms do not require you to submit a dispute to arbitration and do not prevent you from bringing or taking part in a class action.
10. Language
These Terms are written in French and also published in English. The French version is the reference version: if the two versions differ, the French version prevails.
11. Changes to these Terms
Effective date
These Terms apply to the use of the site from their effective date, shown at the top of this version. They then replace, for the future only, the terms that applied until then. What happened before that date remains governed by those terms, reproduced in the version history at the bottom of this page.
Continuing to use the site before that date does not mean that you accept this version. If you do not accept it, you may stop using the site, at no cost, and ask us to delete your personal information by writing to privacy@atlantisstrength.com.
Future changes to this version will follow the rules below.
What we may change
We may change only the following elements of these Terms:
- our contact details and the information that identifies us (section 1);
- the description of the tools, forms and services offered on the site, when we add, change or remove them (sections 3 and 4);
- the rules on what you send us (section 4);
- the acceptable use rules (section 5);
- the intellectual property rules and the licence for documents (section 6);
- the information on third-party links and services (section 7).
We may never change an essential element of these Terms in this way, such as free access to the site.
Notice and its content
Every change is the subject of a written notice, which we provide to you at least 30 days before the change takes effect: we display it on the site for the whole notice period and, if we have an ongoing relationship with you related to the use of the site and know your email address, we also send it to you by email.
The notice, written clearly and legibly, contains only:
- the new or amended clause;
- the previous version of that clause;
- the date on which the change takes effect;
- your rights, described below.
Every version of these Terms, with its publication and effective dates, remains available in the version history at the bottom of this page.
Your rights
You may refuse any change and end your relationship with us under these Terms, at no cost and without penalty or cancellation fee, by sending us a written notice to that effect no later than 30 days after the change takes effect, at info@atlantisstrength.com or at the address given in section 1. You may also stop using the site at any time, at no cost. In addition, you may ask us to delete your personal information by writing to privacy@atlantisstrength.com.
A change applies only to the use of the site from its effective date. It never has retroactive effect: what happened before remains governed by the version then in force.
What is not a change
A rule imposed by a law, a regulation or a decision of a competent authority applies by operation of that law or decision, from the date it sets. Correcting an error, such as a typo or an inaccurate contact detail, that changes nothing of substance is not a change to these Terms. In both cases, we publish a notice on the site as soon as possible.
12. Severability and contact
If a clause of these Terms is found to be void or unenforceable, only that clause is set aside, and only to that extent; the other clauses remain in effect.
For any question about these Terms, write to us at info@atlantisstrength.com or by mail to Atlantis Strength Inc., 4745 avenue des Industries, Laval, Quebec H7C 1A1, Canada, or use our Contact us page. For any question about your personal information, write to privacy@atlantisstrength.com.
